Our Chapter 7 Bankruptcy Practice
In a Chapter 7 bankruptcy proceeding, you can permanently discharge certain types of unsecured debt, such as personal loans, credit card obligations, lines of credit and medical bills. Under the recent revisions to the bankruptcy laws, you must qualify to obtain protection under Chapter 7, demonstrating to the bankruptcy court through a means test that you lack the resources to repay your creditors.
When you hire us to take you through a Chapter 7 bankruptcy filing, we will carefully examine all your resources and obligations and conduct a means test analysis for you, so that you know immediately whether you qualify. We will then make certain that you understand which debts may be discharged through Chapter 7 so that you can make an informed decision as to whether a Chapter 7 filing will be beneficial for you. Some obligations, such as child support arrearage, are generally not dischargeable in bankruptcy. Others, including student loan payments and certain tax debts, are difficult to discharge and may require special circumstances.
We will handle all matters related to the bankruptcy, preparing and filing all necessary documentation and representing you in all hearings or proceedings throughout the course of the bankruptcy.
